Booking and Cancellation Terms

These booking and cancellation terms govern the booking of accommodation at Apartmány pod Jizerkami.

1. Operator

The operator of the accommodation (the “operator”) is:

2. Making a booking

A stay can be booked through the booking form on the website, by e-mail, by telephone or in any other way agreed with the operator.

Submitting the booking form or an inquiry does not in itself guarantee availability of the requested dates and creates no obligation to pay. A booking becomes binding once the operator confirms it and the full price of the stay is paid, unless the guest and the operator agree otherwise.

When booking, the guest must provide truthful and complete contact details, the requested dates, the number of guests and information about any pet.

3. Price and fees

The price of the stay is communicated to the guest before the booking is confirmed. It covers the services expressly stated in the offer or in the booking confirmation. All prices include VAT.

The local tourist tax of the municipality of Bílý Potok is included in the price – guests do not pay it separately, the operator remits it.

The guest must provide the details required for the statutory guest register.

4. Payment terms and due dates

To confirm a booking, payment of the full price of the stay, i.e. 100% of the agreed price, is required in advance by bank transfer. The guest receives the payment details together with the booking confirmation or on the invoice issued.

The following due dates apply:

  • The standard due date is 14 days from the date the invoice is issued, and in all cases no later than 7 days before the agreed day of arrival.
  • If the booking is made less than 14 days before arrival, the price is due within 3 business days of the booking confirmation, and in all cases no later than the last business day before the day of arrival.
  • If the booking is made less than 3 days before arrival, payment on arrival (in cash or by transfer) may be agreed individually with the operator. Until payment is made, the operator does not guarantee the dates and may offer them to another guest. The operator will issue a proof of payment on request.

Whichever deadline falls first always applies. The price is deemed paid when the payment is credited to the operator's account.

If the payment is not credited to the operator's account within the set period, the operator is entitled to cancel the booking, even without prior notice. The operator will usually remind the guest of an outstanding payment but is not obliged to do so. A booking cancelled for non-payment does not oblige the guest to pay a cancellation fee under Article 5.

5. Cancellation by the guest

The guest must notify the operator of a cancellation in writing at info@apartmanypodjizerkami.cz.

The moment of cancellation is the date and time when the cancellation notice was delivered to the operator.

The following cancellation fees apply to a confirmed booking:

What matters is the number of whole calendar days between the day the cancellation is delivered to the operator and the planned day of arrival.

Any amount the guest is entitled to after deduction of the cancellation fee will be refunded by bank transfer to the account from which the payment was made, within 14 days of the cancellation at the latest, unless agreed otherwise.

6. Change of dates

The guest may request a change of the dates of the stay. A change is free of charge at any time before the planned arrival, but always subject to agreement with the operator and to available capacity.

A change of dates is not an entitlement. New dates become binding only once confirmed in writing by the operator.

If the price of the stay for the new dates is higher, the guest must pay the difference. If the price of the new stay is lower, the difference is not refunded.

If the guest subsequently cancels the replacement dates as well, the cancellation fees under Article 5 apply, with the deadlines counted from the day of arrival of the originally agreed dates. The price paid is not refunded up to the amount of the cancellation fee.

7. No-show and early departure

If the guest does not arrive and has not cancelled the booking in advance, the cancellation fee is 100% of the total price of the stay.

If the guest arrives later or ends the stay early by their own decision, no refund is due for the unused days or services.

8. Cancellation by the operator

If the operator cannot provide the booked accommodation for serious operational, technical or other unforeseeable reasons, the guest will be informed without undue delay.

The operator may agree with the guest on replacement dates or another suitable solution. If no agreement is reached, the operator will refund all payments received for the stay that did not take place.

Refunding the price paid is without prejudice to any further rights the guest has under applicable law.

9. Number of guests and capacity

The stay is intended solely for the number of people stated and confirmed in the booking.

The accommodation consists of 3 apartments, each with a capacity of 4 guests. The total bed capacity of the whole property is 12 guests.

A child up to 6 years of age who does not require their own bed is not counted towards the bed capacity – 1 per apartment, 2 for the whole property. Such a child must still be declared in the booking.

The number of guests may be increased only with the operator’s prior consent, within the maximum capacity and against payment of the corresponding price difference.

The operator may refuse to accommodate people who were not stated in the booking or whose stay was not agreed in advance.

10. Handover of the apartment

The apartment will be handed over clean, equipped and fit for proper use.

Check-in is from 15:00, check-out by 11:00. A different time is possible only by prior arrangement with the operator.

The guest must report any defects or shortcomings to the operator without undue delay after discovering them so that the operator can arrange a remedy.

The guest must use the apartment, its equipment and the common areas properly, comply with the house rules displayed in the apartment and prevent damage.

11. House rules and quiet hours

The guest must observe quiet hours from 22:00 to 06:00, both in the apartment and in the common areas and around the property. Quiet hours may also be regulated by a generally binding decree of the municipality of Bílý Potok.

As other guests may be staying in the property at the same time, the guest must be considerate and must not disturb others with excessive noise during the day either.

Parties, celebrations and other group events are permitted only with the operator’s prior consent.

Smoking is prohibited throughout the property.

In the event of a serious or repeated breach of these rules, the operator is entitled to end the guest’s stay without compensation and without any refund for the unused days (Section 2331 of the Czech Civil Code).

12. Pets

Pets are welcome in the apartments, but always only by prior arrangement with the operator and after being declared in the booking. The fee is 250 CZK / animal / night.

The guest undertakes to observe the following rules:

  • The animal must not be on the beds, sofas or any upholstered furniture. The guest must ensure the animal has no free access to them.
  • The guest must clean up the animal’s excrement immediately, both on the property and in its immediate surroundings.
  • The animal must not be left in the apartment unattended.
  • The guest must report any damage caused by the animal – damaged equipment, soiling, scratches and the like – to the operator without undue delay.
  • The guest is responsible for the animal’s behaviour towards other guests and must ensure it does not disturb them with noise.

If the guest breaches the ban on the animal being on the beds and upholstered furniture, or the duty to clean up after the animal, the operator is entitled to charge the guest the cost of extraordinary cleaning of the bedding and upholstered furniture. This is without prejudice to the operator’s right to compensation for the actual damage.

13. Deposit and liability for damage

For a whole-property rental the operator may require a refundable deposit of 5 000 CZK, payable together with the price of the stay or on arrival at the latest, as agreed with the operator. The deposit is not a condition of the booking and the operator need not require it.

If a deposit is paid, it secures any claims of the operator arising from:

  • damage to the apartment, its equipment or the common areas,
  • loss of keys,
  • the cost of extraordinary cleaning beyond the usual cleaning after a stay.

Any unused part of the deposit will be returned to the guest by bank transfer within 14 days of the end of the stay at the latest. If the operator makes any claim against the deposit, the guest will be told the reason and the amount.

The deposit does not cap the amount of compensation for damage. If the damage exceeds the deposit, the guest must pay the difference.

The guest is liable for damage caused by themselves and by the people and animals staying with them.

14. Bookings through third-party portals

For bookings made through third-party portals such as Booking.com, the payment, booking and cancellation terms are governed primarily by the terms stated for that specific booking on the portal concerned.

These booking and cancellation terms apply only to the extent that they do not conflict with the terms of the specific booking made through that portal. The house rules under Articles 9 to 13 always apply.

15. Withdrawal from a distance contract

Accommodation for specific dates is a service provided on a specific date or during a specific period. Under Section 1837(j) of Act No. 89/2012 Coll., the Civil Code, the statutory 14-day consumer right of withdrawal from distance contracts therefore DOES NOT apply to the accommodation contract.

The option to cancel a booking and any refund of the price paid are therefore governed by the cancellation terms set out above.

16. Personal data and the guest register

The operator processes guests’ personal data to the extent necessary to conclude and perform the accommodation contract and to comply with statutory duties, in particular keeping the guest register, reporting the stay of foreign nationals and records for the local tourist tax.

17. Complaints and dispute resolution

Complaints: info@apartmanypodjizerkami.cz. Supervision is exercised by the Czech Trade Inspection Authority (https://www.coi.gov.cz), which is also the body for out-of-court consumer dispute resolution (ADR) – https://adr.coi.gov.cz.

18. Final provisions

The operator may amend these terms to a reasonable extent. The terms in force at the moment a booking is confirmed are decisive for that booking.

By confirming a booking, the guest confirms that they have read, understood and agree to these booking and cancellation terms.

These booking and cancellation terms are valid and effective from 12 August 2026.
